FWC once again enforcing Florida's net ban

Florida wildlife officers are once again enforcing the net ban.
The enforcement on the net ban has been on-again off-again for the past few weeks since Leon County Judge Jackie Fulford ruled that the manner in which the net ban is being enforced is unfair to mullet fishermen and not in keeping with the intent of the constitutional amendment.
Fulford’s order stopped enforcement of the ban.
The Attorney General’s office filed a notice of appeal which reinstated the ban until the matter can be resolved in court.
Last week, judge Fulford granted a request that lifted the automatic stay of her order.
But now the ban is being enforced again
Late Wednesday, Florida’s First District Court of Appeal reinstated the automatic stay. and the FWC issued a memo directing its officers to resume enforcement of the net limitation amendment and all associated statutes and rules.

The memo warns officers that this continues to be a sensitive issue and that there is great potential for confusion among fishermen and other members of the public.

The memo urges officers to use ample discretion and seek to educate any fishermen that may have misinformation or be unclear on the current circumstances.
