Mistrial for former teacher accused of sexual misconduct with a student

 A former teacher at the Franklin County school will be retried on charges of sexual misconduct with a student after a local jury was unable to reach a verdict in his first trial last week.
31 year old Gerald Tate worked as a high school teacher and assistant football coach when he was arrested in September, 2014 and charged with lewd and lascivious molestation of a female student.
It was alleged that during the last week of school in May, 2014 Mr. Tate sexually molested a child and threatened that there would be consequences if anyone was told about it.
Based on the student accounts FDLE Crime Scene technicians were called in and examined a specific room for evidence where they found samples that tested positive for semen. 
Tate's first trial ended September 23rd with a mistrial.
A new trial is scheduled to begin on October 13th.
