The Shuler family in
Apalachicola could receive a little over 670 thousand dollars from the state to
repay them for damages to about 835 acres of timber that were burned during a
controlled burn in the Tate’s Hell state forest.
The incident happened
in 2008 on property owned by the Shuler’s near Cash Creek.
The Shulers sued the
state and won – the jury found the forest service negligent and awarded the
Shuler Limited Partnership over 740 thousand dollars.
The state, however,
only had to pay 100 thousand dollars because of the Florida’s sovereign-immunity
laws.
Last Thursday, Senator
Bill Montford filed a claims bill that would allow the Shulers to collect the
rest of their money.
The bill will be considered
during the 2016 session.
Similar bills were
filed for the 2015 session in the House and Senate but did not pass.
