Franklin county hires constitutional scholar to review proposed nudity ordinance

Franklin county commissioners have agreed to pay up to 12 thousand dollars to have a first amendment scholar look over its proposed nudity ordinance.

The county voted earlier this year to tighten the language in the county’s nudity ordinance because of a Las Vegas style male revue that was held in early March.

The Revue did not violate the existing nudity ordinance which was written in 1998, but many people said it did violate local morality standards.

At that time county commission voted to strengthen the existing ordinance to stop any future events like the male revue – they said they will also address the issue of alcohol on local beaches.

Commissioners said they want to make very sure that the ordinance does not violate anyone’s constitutional rights.

County attorney Michael Shuler said he has used an existing ordinance from another county as the basis for Franklin County’s nudity ordinance – he said the other ordinance has already been successfully defended in court.

He did point out that he is not a constitutional scholar and recommended the county hire one to conduct a study and provide an opinion to the board about the nudity ordinance.


Commissioners felt that was a good step and agreed to the expense.
