Appeals court rejects request to revisit Lake Lanier decision


If Florida wants to overturn a recent federal appeals court ruling that gives Atlanta the right to tap Lake Lanier for drinking water it will have to go to the US Supreme Court to do it.

The 11th U.S. Circuit Court of Appeals in Atlanta rejected a request Friday to revisit the issue.

This latest ruling is just the latest in a 20 year battle over water rights from the Apalachicola Chattahoochee Flint River System.

In 2009 a federal court ruled Atlanta did not have the right to take water from Lake Lanier; that decision was overturned by the court of appeals this summer.

That decision gives the U.S. Army Corps of Engineers one year to figure out how to give Georgia access to more water while still considering the water needs of downstream users and wildlife when making their decision.
